Effective December 1, 2017, Judge Woods amended her Bankruptcy Court Policies and Procedures Memorandum and issued several new and amended administrative orders to effectuate implementation of Official Form 113 – Chapter 13 Plan. Practitioners in the Youngstown Bankruptcy Court should review these documents, which are available on the Court’s website.
The following changes to practice and procedure in Youngstown are of particular importance: (i) as set forth in greater detail in Second Amended Administrative Order No. 14-03, Official Form 113 must be used in all chapter 13 cases in which a chapter 13 plan has not been filed on or before November 30, 2017; (ii) confirmation hearings will no longer be held on the same date as the § 341 meeting of creditors; (iii) any requests to continue confirmation hearings must be accomplished by motion, and (iv) the form entitled Rights and Responsibilities of Chapter 13 Debtors and Their Attorneys, which must be executed and filed in order for chapter 13 debtors’ counsel to receive no-look fees, has been amended and uploaded to the Court’s website.
